On 22 October 2021, in consideration of the evolution of European regulations, IVASS and CONSOB signed a Framework Agreement to strengthen the long-standing cooperation between the two Authorities, in order to better guarantee the investors and policyholders in their financial transactions and ensure a higher stability of the financial and insurance system.
To this purpose, the Agreement guarantees maximum collaboration and cooperation between the Authorities in the execution of their institutional functions. In particular, it includes:
- the commitment of each Authority to limit the burdens on the supervised entities
- the signing of agreements on matters of common interest, through the exchange of documents held by each Authority, also in the implementation of national and/or European provisions
- the establishment of Contact Committees (strategic and technical) which will be responsible in particular for implementing cooperation and coordination activities
specific rules for the Authorities concerning the confidentiality of shared information and relations with other institutions and/or bodies other than the subscribers to this Agreement.
NUOVO ACCORDO QUADRO TRA IVASS E CONSOB PER LA COOPERAZIONE ED IL COORDINAMENTO NELL’ESERCIZIO DELLE RISPETTIVE ATTIVITÀ DI CONTROLLO
Il 22 ottobre 2021, alla luce dell’evoluzione della normativa europea, IVASS e CONSOB hanno sottoscritto un Accordo quadro per rafforzare la collaborazione già esistente tra le due Autorità, al fine di garantire maggiormente gli investitori e i contraenti nelle loro operazioni finanziarie e garantire una maggiore stabilità del sistema finanziario e assicurativo.
A tal fine, l’Accordo garantisce la massima collaborazione e cooperazione tra le Autorità nello svolgimento delle proprie funzioni istituzionali. In particolare, prevede:
- l’impegno di ciascuna Autorità a contenere gli oneri gravanti sulle entità vigilate
- la stipula di protocolli d’intesa su materie di comune interesse in attuazione mediante lo scambio di documenti in possesso di ciascuna Autorità, anche in attuazione di disposizioni nazionali e/o europee
- l’istituzione di Comitati di Contatto (nello specifico, uno strategico e uno tecnico) che cureranno in particolare l’attuazione delle attività di collaborazione e coordinamento
- regole specifiche in capo alle Autorità in materia di riservatezza sulle informazioni condivise e sui rapporti con altre istituzioni e/o enti diversi dai sottoscrittori del presente Accordo.
