Ministerial Decree n. 215, published 9 January 2025 in the Italian Official Gazette

The Ministerial Decree on Insurance Arbitration n. 215, concerning ADR disputes relating to insurance matters and the criteria for the constitution of a decision-making body, was published in the Italian Official Gazette dated 9 January 2025.

Pursuant to this Ministerial Decree, the Insurance Arbitrator is established with IVASS and shall have jurisdiction for disputes concerning insurance contracts falling within certain value limits: up to 300.000,00 for life-insurance (Class I) and up to 25.000,00 for non-life insurance (Class III). As a result of being enrolled in the proper register, Insurance Companies and Intermediaries automatically adhere to Insurance Arbitration.

Intermediaries and Insurance Companies operating in Italy under the freedom to provide services may choose not to adhere but, in this case, they must give due notice of the different ADR procedure to be adhered to in their own country.

The pre-condition for accessing this Alternative procedure is the submission of a complaint to an Insurance Company or Intermediaries.
