On April 18 2024, the European Supervisory Authorities (EBA, ESMA, and EIOPA, collectively the “ESAs”) launched a public consultation on the draft Regulatory Technical Standards (RTS), concerning the conduct of supervisory activities related to joint examination groups under Regulation (EU) 2022/2554 (Digital Operational Resilience Act, DORA).
The regulatory technical standards (RTS) – developed in accordance with Article 41 of DORA, under which «the ESAs, through the joint committee, develop draft regulatory technical standards» – aim to define the criteria for determining (i) the composition of the joint examination group, established on European level to operate in the field of ICT (Information and Communication Technologies) and to carry out supervisory activities, assisting the relevant supervisory Authority, and (ii) the nomination of its members, their tasks, and working methods, ensuring a balanced participation of the ESAs and the national Supervisory Authorities.
DORA and its related RTS will apply as from January 17, 2025. The ESAs invite interested parties to submit their comments on the draft RTS by May 18, 2024, as they will be submitted to the European Commission by July 17, 2024.
